  Au moment où les chefs d’État et de gouvernement de l’Union européenne, réunis à Paris les 15 et 16 octobre, viennent d’adopter le Pacte européen pour l’asile et l’immigration proposé par la présidence française, la CFDA (Coordination française pour le droit d’asile) rend publiques ses préoccupations à propos de l’évolution de la situation de l’asile en Europe dans une note intitulée « Bâtir une Europe de l’asile » : à quel prix ?

• Access to protection at airports in Europe

  In most Member States of the EU, the number of persons crossing the state border at airports far exceeds those at land or sea borders. Yet access of asylum seekers to the territory and the asylum procedure is often unregulated or ad hoc at such entry points. Although international and European laws contain rules and guidelines to ensure that refugees can have access to Europe, practices often do not reflect the protection envisaged in law.

• Resolution of 2 September 2008 on the evaluation of the Dublin System

  In an own-initiative report adopted by the European Parliament, MEPs call on the Commission to complement the Dublin system with measures in order to make it fairer for migrants as well as member states, by sharing the work of examining asylum applications and ensuring better rights for claimants. Detention should be used only as a last resort solution, MEPs say.

Pourtant, dans la plus grande indifférence politique, les migrants ont continué à affluer le long du littoral de la Manche et de la Mer du Nord.

Il représente aussi un important facteur de croissance et de prospérité. L’élargissement récent et à venir de l’espace Schengen conforte encore la liberté de circulation des personnes.

  Asylum applications are a 14-year low, yet the proportional use of detention has increased 7-fold. The government is driven by seemingly arbitrary targets on deportation and has just announced a near doubling of detention centre capacity. «Mass deportations» may follow if the government puts into effect its announcement made in August 2007 to deal with 450,000 unresolved asylum cases within 5 years or less.

On the one hand, armed conflicts resulted in the movement of millions of people within and outside their countries; on the other hand, millions of displaced were able to return home or found another durable solution. However, the net result of these developments was that the number of people uprooted by armed conflict continued to rise for the second consecutive year.

The issue finds itself high on the priority lists of nearly all EU Council presidencies and forms part of the Strategic Objectives of the Barroso Commission. Yet the ‘migration dossier’ is highly complex as it comprises a considerable number of different facets, making it nearly impossible to find a «one size fits all» approach.

  The European Council considers that the time has come to provide a new impetus, in a spirit of mutual responsibility and solidarity between Member States and also of partnership with third countries, to the definition of a common immigration and asylum policy that will take account of both the collective interest of the European Union and the specific needs of each Member State.

  Le projet de création d’un « Observatoire européen des frontières » permettra, à travers un regard non gouvernemental, d’informer sur la situation des migrants aux frontières, de dénoncer les violations des droits qui y sont commises, de contribuer à leur respect, et ainsi d’améliorer la prise en compte des droits fondamentaux dans les politiques d’immigration des pays de transit et d’accueil.

• Taking forward the common immigration and asylum policy for Europe

  Today the Commission adopted a Communication on «A Common immigration policy for Europe: principles, actions and tools» and a Policy Plan «Asylum – an integrated approach to protection across the EU». The Communication puts forward ten Common Principles on which to base the common immigration policy, grouped under the three main strands of EU policy: prosperity, solidarity and security. The Policy Plan on Asylum provides for the architecture of the second phase of the Common European Asylum System (CEAS). Both address the remaining elements on immigration and asylum of The Hague Programme. They should be endorsed by the European Council of 15 October 2008 and will, in the course of 2009, feed into a new five-year Programme in the Justice, Freedom and Security area.

• Promouvoir la politique commune de l’immigration et de l’asile pour l’Europe

  La Commission a adopté aujourd’hui une communication intitulée « Une politique commune de l’immigration pour l’Europe : principes, actions et instruments », ainsi qu’un plan d’action dénommé « plan d’action en matière d’asile : une approche intégrée de la protection au niveau de l’Union ». La communication présente dix principes communs sur lesquels la politique commune de l’immigration doit se fonder. Ces principes sont rattachés aux trois principaux volets de l’action de l’UE que sont la prospérité, la solidarité et la sécurité. Le plan d’action en matière d’asile prévoit quant à lui l’architecture de la seconde phase du régime d’asile européen commun (RAEC). Les deux textes portent sur les éléments restants concernant l’immigration et l’asile du programme de La Haye. Ils devraient être approuvés par le Conseil européen du 15 octobre 2008 et seront intégrés courant 2009 dans un nouveau programme quinquennal dans le domaine de la justice, de la liberté et de la sécurité.

  In 1999 the EU Heads of State and Government meeting in Tampere called for the establishment of a Common European Asylum System. Since then, asylum has been considered an issue to be tackled at EU level. Indeed, in a Union with no borders, it makes sense to harmonise conditions for asylum seekers and avoid that one country is seen as more attractive than others. This will reduce unwarranted secondary movements; asylum seekers will no longer have the impression that some Member States have a more generous - or restrictive - attitude than others.
