• Denmark: Murder plot suspects to remain in jail

  Copenhagen District Court determined that two Tunisian men charged with planning to murder Muhammad cartoonist Kurt Westergaard, ought to remain in custody, citing that the two are «a danger to national security.» The court’s decision upheld their imprisonment until August 12th, and was based on evidence presented by the national intelligence agency, showing that it was «likely» that the two were guilty of conspiracy to kill Westergaard.

• Denmark: Three Muslims attacked after embassy bombing in Pakistan

  Former spokesperson of the Islamic Faith Society (ISF) Kasem Said Ahmed was attacked on his way to work, shortly after the attack on the Danish embassy in Islamabad, Pakistan was announced in the Danish media. The attack occurred in Copenhagen, and Ahmed said he was punched in the face after being asked if he was an imam.

Das dänische Beschäftigungswunder wird dabei als Gegenentwurf zu einer Politik wohlfahrtsstaatlichen Rückbaus gesehen, denn in Dänemark existieren ein flexibler Arbeitsmarkt und umfassende soziale Sicherungssysteme gleichermaßen. Das mit dem Schlagwort Flexicurity umschriebene Wechselverhältnis gilt als Geheimnis des dänischen Erfolges, Arbeitslosigkeit zu senken und Haushaltsüberschüsse zu generieren ohne größere Einschnitte in den Wohlfahrtsstaat zuzulassen.

Pourtant, parmi les 11 bons élèves européens qui comptabilisent les crimes racistes perpétrés sur leur territoire, 8 ont enregistré, l’année dernière, une augmentation des incidents xénophobes. C’est ce qui ressort du premier rapport publié par la toute nouvelle Agence des Droits Fondamentaux, et présenté lundi en commission des libertés civiles. Selon les mots du rapport, « la violence et les crimes racistes restent une maladie sociale grave à travers l’Europe »

  La crise déclenchée par les caricatures de Mohamed publiées dans des journaux danois n’a pas été une réaction spontanée de colère, elle a été orchestrée par des imams radicaux et ambitieux vivant au Danemark. Devant le refus du Premier ministre danois de limiter la liberté de la presse, les imams ont décidé d’internationaliser la crise.

• A Typology of Different Integration Programmes in the EU

  This Briefing Paper presents a typology of integration programmes for immigrants in selected Member States of the European Union. It first looks at the concept of ‘integration of immigrants’ and its inherent vulnerabilities. It then provides a typology of integration strategies and policies in Austria, Belgium, Denmark, France, Germany and the Netherlands. The cases of Spain, Poland and the UK are also taken into consideration. The main tendencies and common elements are assessed and broadly compared. As the paper shows, there appears to be a move towards a restrictive integration policy for immigrants in the EU. Mandatory participation in integration programmes has become a constituent element of immigration and national citizenship legislation, as well as precondition to having access to a secure status. A nexus between immigration, integration and citizenship is also becoming the norm in a majority of the national legal systems assessed in this paper. The link between the social inclusion of immigrants and the juridical framework on immigration, integration and citizenship may raise human rights considerations, and endanger the inter-culturalism and diversity that are inherent to the character of the EU.

• Recent examples of enforcement actions carried out by data protection authorities

  This comparative report gives brief examples of enforcement measures against breaches of data privacy protection rules in the member states. It shows high levels of variability in terms of penalties (ie minimal fines as in Germany and stiffer penalties elsewhere). Financial penalties are often so low as a percentage of the gain made by the infringer that they are not a deterrent. The compensation to the ‘victim’ can often be trivial and meaningless. There is also variance in what member states focus on when looking into enforcement, The most common areas are health, insurance, tax and payment of telephone bills. The UK looked at police data.

In particular, it was agreed that a proposal aimed at enhancing cooperation with border authorities and establishing contact with Frontex with regard to Intelligence Led Law Enforcement will be completed in the first half of 2006.

• La construction d’une communauté de sécurité en Europe : le cas des pays nordiques

  Dans les pays européens, la sécurité intérieure est du ressort de différents types de police. C’est un legs de l’histoire et des traditions de chacun des Etats mais ce legs aura incontestablement des répercussions lorsqu’il s’agira de traiter, plus avant, de la sécurité à l’échelle de l’Europe. Au plan militaire, l’Europe se dote progressivement de capacités qui devraient répondre, à terme, à l’ensemble des missions dites de Petersberg à savoir : les missions d’action humanitaire et d’évacuation, les missions de maintien de la paix et les missions de force de combat pour la gestion des crises sans oublier depuis peu, la lutte contre le terrorisme. Pour ce qui relève des activités de police en projection extérieure, l’idée qui consisterait à rétablir l’ordre s’il est troublé et à exercer une surveillance des différentes zones abritant des trafics illicites est très largement répandue.

  According to Statewatch sources, the Danish branch of Greenpeace was charged last Wednesday 11th May 2005 under national criminal laws as amended in order to implement UN and EU laws on the financing of acts of terrorism. This may open a precedent for interpreting civil disobedience of activists as «terrorist act», qualifying Non-Governmental Organizations as terrorist under EC Regulation 2580/2001 on specific restrictive measures directed against certain persons and entities with a view of combating terrorism.
