Britain’s security agencies are fighting a covert war in cyberspace against extremist internet sites as part of a new anti-terrorist strategy, senior Whitehall officials revealed this week. The scheme is part of measures being introduced at a time when the threat level is described as being «at the severe end of severe», with, officials say, extremist groups determinedly attempting new attacks. As well running its own sites, the Government gives material support to groups that monitor and combat jihadist material on the web in an attempt to prevent indoctrination of young Muslims.

The arrest of two Muslim extremists at the Cologne-Bonn airport last week shows that German converts continue to volunteer for the jihad. Investigators fear that some are on their way back now that they’ve received training. It was Friday morning, shortly before 7:00 a.m., and all passengers had boarded KLM flight 1804 at the Cologne-Bonn airport. The small Fokker 50 was ready for takeoff. This particular Friday was a special day for devout Muslims, being one of the last days of the holy month of Ramadan.

A link between terrorism plots and hardcore child pornography is becoming clear after a string of police raids in Britain and across the Continent, an investigation by The Times has discovered. Images of child abuse have been found during Scotland Yard antiterrorism swoops and in big inquiries in Italy and Spain. Secret coded messages are being embedded into child pornographic images, and paedophile websites are being exploited as a secure way of passing information between terrorists.

La loi n° 2006-64 du 23 janvier 2006 relative à la lutte contre le terrorisme et portant dispositions diverses relatives à la sécurité et aux contrôles frontaliers (LAT) apporte la réponse la plus opérationnelle possible à la menace terroriste, tant dans le domaine de la prévention qu’en matière de répression des actes de terrorisme. Elle vise également à contribuer à l’efficacité du dispositif de sécurité afin de concourir à la préservation de l’ordre public et à l’amélioration des contrôles frontaliers. Elle comporte donc, à ce titre, certaines dispositions qui concernent la police administrative et d’autres, la répression des actes du terrorisme.

The European Parliament has reserved the right to challenge the legitmacy of the EU PNR-Australia agreement before the Court if a third party also feels that democratic legitimacy has not been respected. Once again, the European PArliament has not been consulted. If the Lisbon Treaty comes into effect, it has argued that all the PNR agreements concluded on a similar basis be submitted to MEPs.

This paper assesses the implications of the European Commission Communications on the evaluation and future development of FRONTEX (European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union) and the establishment of EUROSUR (European border surveillance system). It emphasises that the evaluation of the activities conducted by the EU’s external borders agency over the period 2006–07 fails to address the impact of such undertakings on fundamental rights and freedoms, solely focusing on technical issues and overall efficiency.

The Commission’s proposal to establish an entry-exit system could play a useful role as regards detecting overstayers from states whose nationals are subject to a visa obligation, if implemented in conjunction with a registered traveller system. However, the Commission has not properly explained or calculated the costs of establishing such a system, and has not established the need for such a system as regards non-visa nationals.

On 13 February 2008, the European Commission tabled a ‘border package’, consisting of three communications1 dealing with the issue of EU external border management. Two of these documents, namely the communication on the evaluation and future development of Frontex and the communication on the creation of a European border surveillance system (Eurosur) propose significant evolutions with regard the role of the Frontex agency and the orientations of the EU integrated border management (IBM) concept.

Border management, including the need for a balance between freedom and security, was the subject of a discussion at the EP on Monday between MEPs, national MPs and visiting experts. In the near future Parliament is due to scrutinise several proposals designed to consolidate the system created by the opening up of Europe’s borders and the introduction of the Schengen regime. MEPs will be keen to ensure that fundamental rights and privacy are respected.
