  • Report on Implementation of the Hague Programme for 2007

    The purpose of this exercise is to monitor adoption of the measures envisaged in the Hague Programme both at institutional level (Part I and Annex 1) and their implementation at national level (Part II and Annex 2). This includes the drugs action plan, the strategy covering the external aspects of the area of freedom, security and justice, and the action plan to fight against terrorism, which supplement the Hague Action Plan, in accordance with the set timetable.

    Le présent rapport a pour objet de faire le point sur l’adoption des mesures envisagées dans le programme de La Haye, tant au niveau institutionnel (partie I et annexe 1) que sur le plan de leur mise en oeuvre au niveau national (partie II et annexe 2). Ceci englobe le Plan d’action drogue, la stratégie relative aux aspects externes de l’espace de liberté, de sécurité et de justice et le plan d’action visant à lutter contre le terrorisme, qui complètent le plan d’action de La Haye, conformément au calendrier fixé.

    The French, Czech and Swedish Presidencies will coincide with a period of significant changes for the European Union. The end of 2008 and the beginning of 2009 will be the last period of full-scale activity for the European Parliament and the Commission. The elections to the European Parliament in June 2009 and the appointment of a new Commission during the second half of 2009 will have a profound effect on the work of the three Presidencies.

    La Commission a adopté ce jour son troisième rapport annuel (également nommé « tableau de bord ») sur la mise en oeuvre du programme de La Haye, qui fait le point sur les avancées des politiques menées en matière de liberté, de sécurité et de justice. Le programme de La Haye, qui couvre la période 2005-2009, a pris la suite de celui de Tampere, mis en oeuvre entre 1999 et 2004. Le tableau de bord 2007 évalue les progrès accomplis dans la réalisation des mesures prévues dans le plan d’action de La Haye pour l’année 2007.
  • Commission adopts the third annual report on achievements in Justice, Freedom and Security policies

    Today, the Commission adopted the third annual report on the implementation of the Hague Programme on achievements in Justice, Freedom and Security policies, also referred to as the Scoreboard. The Hague Programme, which covers 2005-2009, is the successor of the Tampere Programme which covered the period 1999-2004. The 2007 Scoreboard assesses progress made vis-à-vis actions envisaged in the Hague Action plan for 2007.
  • Taking forward the common immigration and asylum policy for Europe

    Today the Commission adopted a Communication on «A Common immigration policy for Europe: principles, actions and tools» and a Policy Plan «Asylum – an integrated approach to protection across the EU». The Communication puts forward ten Common Principles on which to base the common immigration policy, grouped under the three main strands of EU policy: prosperity, solidarity and security. The Policy Plan on Asylum provides for the architecture of the second phase of the Common European Asylum System (CEAS). Both address the remaining elements on immigration and asylum of The Hague Programme. They should be endorsed by the European Council of 15 October 2008 and will, in the course of 2009, feed into a new five-year Programme in the Justice, Freedom and Security area.
  • Promouvoir la politique commune de l’immigration et de l’asile pour l’Europe

    La Commission a adopté aujourd’hui une communication intitulée « Une politique commune de l’immigration pour l’Europe : principes, actions et instruments », ainsi qu’un plan d’action dénommé « plan d’action en matière d’asile : une approche intégrée de la protection au niveau de l’Union ». La communication présente dix principes communs sur lesquels la politique commune de l’immigration doit se fonder. Ces principes sont rattachés aux trois principaux volets de l’action de l’UE que sont la prospérité, la solidarité et la sécurité. Le plan d’action en matière d’asile prévoit quant à lui l’architecture de la seconde phase du régime d’asile européen commun (RAEC). Les deux textes portent sur les éléments restants concernant l’immigration et l’asile du programme de La Haye. Ils devraient être approuvés par le Conseil européen du 15 octobre 2008 et seront intégrés courant 2009 dans un nouveau programme quinquennal dans le domaine de la justice, de la liberté et de la sécurité.

    The European Council welcomes the enlargement of the Schengen area and the abolition of controls at the internal borders of the Member States participating in the SIS one4ALL project, as from 21 December 2007 for land and sea borders, and by 30 March 2008 for air borders, thus extending the effective free movement of persons.

    Le Conseil européen accueille avec satisfaction l’élargissement de l’espace Schengen et l’abolition des contrôles aux frontières intérieures des États membres qui participent au projet SIS « one4ALL », à compter du 21 décembre 2007 pour les frontières terrestres et maritimes, et d’ici le 30 mars 2008 pour les frontières aériennes ; cette mesure étend ainsi la libre circulation des personnes dans les faits.
  • The Commission regrets delay in transposition of European rules on procedures for granting asylum

    On 1 December 2007, the deadline for transposition of the Asylum Procedures Directive (Council Directive 2005/85/EC of 1 December 2005, on minimum standards on procedures in Member States for granting and withdrawing refugee status) expired. Until today, only 6 Member States (Bulgaria, Germany, Luxemburg, Austria, Romania and the United Kingdom) have communicated their national measures informing that they transpose fully the Directive. 4 Member States (Belgium, Estonia, France and Lithuania) have notified partial transposition.
  • Achieving common EU standards on reception of asylum seekers: Report on transposition and implementation of the Reception Conditions Directive

    The European Commission has issued today its report evaluating the implementation by Member States of the Directive laying down minimum standards for the reception of asylum seekers (Directive 2003/9/EC of 27 January 2003). - often referred to as the Reception Conditions Directive. The results of the evaluation report, along with the conclusions of the consultation on the Green Paper on the future Common European Asylum System, recently launched by Vice-President Franco Frattini, will, by 2010, form the basis of a more harmonised legislative framework relating to reception conditions. This is in line with the objectives of the Hague Programme.

    La Commission européenne a publié aujourd’hui son rapport évaluant la mise en oeuvre par les États membres de la directive relative à des normes minimales pour l’accueil des demandeurs d’asile (directive 2003/9/CE du 27 janvier 2003), souvent appelée la « directive relative aux conditions d’accueil ». Les résultats du rapport d’évaluation, ainsi que les conclusions de la consultation sur le livre vert sur le futur régime d’asile européen commun, récemment lancée par le vice-président Frattini, constitueront d’ici 2010 le fondement d’un cadre législatif plus harmonisé en matière de conditions d’accueil. Cela est conforme aux objectifs du programme de La Haye.

  • Proposal for a COUNCIL DIRECTIVE on the conditions of entry and residence of third-country nationals for the purposes of highly qualified employment

    This proposal forms part of the EU efforts to develop a comprehensive immigration policy. The Hague Programme of November 2004, recognised that «legal migration will play an important role in enhancing the knowledge-based economy in Europe, in advancing economic development, and thus contributing to the implementation of the Lisbon strategy», and asked the Commission to present a policy plan on legal migration «including admission procedures, capable of responding promptly to fluctuating demands for migrant labour in the labour market». The December 2006 European Council agreed on a series of steps to be taken during 2007, including to «develop, as far as legal migration is concerned, well-managed migration policies, fully respecting national competences, to assist Member States to meet existing and future labour needs (…) the forthcoming Commission proposals within the framework of the Policy Plan on Legal Migration of December 2005 should be rapidly examined».

    Eurojust was set up, following the positive experience of Pro Eurojust, by a Decision of 28 February 2002 (« the Decision ») ; since then it has proved effective in bringing about a real improvement in the operation of law enforcement cooperation between the 27 Member States and has recorded significant operational successes.In the Hague Programme the European Council asked the Commission to consider Eurojust’s further development. Specialists in judicial cooperation met to discuss the issue in Vienna in September 2006 . The European Judicial Network has contributed to the process . Eurojust itself has also made a contribution. In conclusions adopted on 13 June last, the Council once again asked the Commission to present a communication on the role of Eurojust and the European Judicial Network .

    The Hague Programme invites the Council to consider the «further development of Eurojust», on the basis of a COM proposal. Furthermore, under the Action Plan for the Hague Programme, COM should have presented a proposal for a ’European law’ (on the basis of the Constitution) on Eurojust in 2006. In view of the developments regarding Constitution/Reform Treaty, COM decided to first adopt a Communication on the development of Eurojust and the EJN.

En outre, conformément au plan d’action du programme de La Haye, la Commission aurait dû présenter en 2006 une proposition de « loi européenne » (en vertu de la Constitution) relative à Eurojust.     Under the Hague Programme (No. 2.1.), better exchange of information, including by means of more extensive access to existing EU information systems, is one of the ways in which the aim of strengthening security is to be achieved. To combat terrorism and other serious crimes it is inevitable that police and law enforcement authorities have access, within the scope of their powers, to the most comprehensive and up-to-date information possible.
